Terms & Event Disclaimers (2026 Update)
Last Updated: October 14, 2026
These Terms & Event Disclaimers (“Event Terms”) apply to all live and virtual events, seminars, workshops, webinars, bootcamps, and training sessions (each an “Event”) offered by K-Method Training Group, Inc., including events presented by Kurtis Smith and events offered under the K-Method Success Academy and WorkCertified names (“K-Method,” “we,” “us,” or “our”). By registering for or attending an Event, you (“Attendee”) agree to these Event Terms, our Membership Terms of Use, and our Privacy Policy. If you do not agree, please do not register.
1. Registration and Eligibility
Registration is confirmed when you receive a confirmation email. Your registration is personal to you unless we approve a transfer (see Section 8). Attendees under 18 may attend only with written consent from a parent or legal guardian, or through a Sponsoring Organization (such as a workforce board, school, or employer) that has obtained that consent, and may be required to have a supervising adult present for in-person Events.
2. Attendee Conduct
We are committed to a respectful, professional, and safe learning environment. Attendees must treat staff, speakers, venue personnel, and other attendees with respect at all times, including during breaks and Event-related social activities and in virtual chat rooms. Harassment, discrimination, threats, disruptive behavior, being under the influence of alcohol or illegal substances, and possession of weapons where prohibited are not allowed. We may remove any Attendee who violates these standards, without refund, and may decline future registrations.
3. Health, Safety, and Assumption of Risk
We take reasonable steps to provide a safe Event, but we do not control venues, travel, or every circumstance. Attendance at in-person Events involves ordinary risks, including travel, slips and falls, and illness. You voluntarily assume these risks.
Release. To the fullest extent permitted by law, you release K-Method, Kurtis Smith, and their officers, employees, contractors, speakers, sponsors, and venues (the “Released Parties”) from claims for injury, illness, death, or property loss or damage arising from your attendance or participation, including claims arising from the ordinary negligence of the Released Parties. This release does not apply to gross negligence or intentional misconduct. For Attendees under 18, the parent or guardian who consents on the minor’s behalf agrees to this section to the extent permitted by Florida law (Fla. Stat. § 744.301(3)).
Medical. If you need emergency care during an Event, you authorize us to seek it for you and you are responsible for its cost. Please tell us in advance about any medical condition or accommodation you want us to know about. We are not obligated to provide medical services.
Indemnification. You agree to indemnify the Released Parties for claims and expenses caused by your own negligent or intentional acts during an Event.
4. Accessibility
We want every Attendee to participate fully. If you need an accommodation, such as captioning, seating, or materials in an accessible format, contact us at least [10] business days before the Event and we will make reasonable efforts to provide it.
5. Educational Purpose; No Professional Advice
Events are educational. Information presented is not legal, financial, tax, medical, psychological, or other professional advice and does not replace advice from a qualified professional. You are responsible for your own decisions and how you apply what you learn.
6. Results, Earnings, and Employment Disclaimer
We work hard to describe our Events accurately. However, we do not guarantee any particular result, including income, sales, job placement, employment, promotion, or business success. Your results depend on many factors, including your skills, effort, experience, market, and circumstances. Any examples of results, earnings, or success stories shared by us or by speakers are illustrations, are not typical, and are not promises of what you will achieve. Forward-looking statements are opinions, not guarantees.
Testimonials and endorsements. Testimonials reflect the real experiences of the people giving them. If a person giving a testimonial or endorsement received compensation, free access, or another benefit, or has a business relationship with us, we will disclose it.
7. Intellectual Property and Confidentiality
Event content, including presentations, frameworks, workbooks, handouts, tools, and processes, is owned by K-Method and protected by copyright and trademark law. You may use Event materials for your own personal or professional development. You may not record, reproduce, distribute, sell, or use Event content to teach, train, or coach others without our prior written permission. We will pursue all available remedies for unauthorized use. See our Copyright Policy & DMCA Notice.
8. Cancellations, Refunds, and Transfers
Cancellation by you. You may cancel for a full refund within 10 days after registering, as long as the Event is more than [14] days away. If you register within [14] days of the Event, refunds are available only until [7] days before the Event. After the applicable deadline, fees are non-refundable, but you may (a) transfer your registration to another person by notifying us at least [48 hours] before the Event, or (b) apply your registration to a future Event on the same topic, subject to availability and at our discretion.
Cancellation or changes by us. If we cancel or postpone an Event, you may choose a full refund or a credit toward a future Event. If we materially change an Event’s date, format, or location, you may cancel for a full refund. We are not responsible for travel or lodging costs you incur.
Removal. Attendees removed under Section 2 are not entitled to a refund.
This policy does not apply to consulting, coaching, or organizational training contracts, which are governed by their own agreements.
9. Satisfaction Guarantee
[Where advertised for a specific Event:] If you attend the entire Event and believe we did not deliver what we promised in the Event description, tell an Event staff member before you leave, or email us within [3] days after the Event, and return any printed materials provided. We will refund your registration fee. The guarantee applies only to Attendees who attend the full Event and does not replace the cancellation policy in Section 8.
10. Photography, Recording, and Release
Attendee recording. Attendees may not record audio or video or take photographs of Event sessions without our written permission.
Our recording. We may photograph, record, or livestream Events. By attending, you grant K-Method permission to use photographs and recordings in which you appear, including your name, likeness, voice, and comments, in any media to document, promote, and provide our programs, without compensation. If you do not want to appear in marketing materials, notify Event staff at check-in or email us before the Event, and we will make reasonable efforts to exclude you. We will not use images or recordings of Attendees under 18 in marketing without separate written consent from a parent or guardian. We will ask for separate permission before using your words as a written testimonial.
11. Virtual Events
For virtual Events, you are responsible for your own internet connection, device, and software. We are not responsible for technical problems on your end. If a virtual Event is interrupted by a problem on our end, we will provide a recording or a replacement session. Links to virtual Events are for registered Attendees only and may not be shared.
12. Content Advisory
Some adult-audience Events may discuss mature professional topics in direct, candid language. Events for youth or workforce-readiness programs, including WorkCertified and YESS, follow age-appropriate content standards.
13. Limitation of Liability
To the fullest extent permitted by law, K-Method’s total liability arising from any Event will not exceed the registration fee you paid for that Event, and K-Method will not be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits. This does not apply to gross negligence or intentional misconduct.
14. Governing Law and Disputes
These Event Terms are governed by Florida law. Disputes will be resolved as provided in the “Dispute Resolution” section of our Membership Terms of Use, which applies to these Event Terms as if fully set out here. Informal resolution first. Before filing any claim, you and K-Method agree to try to resolve the dispute informally by sending a written notice describing it. Notices to K-Method go to the address in Section 20. If the dispute isn’t resolved within 30 days, either party may proceed as described below.
Arbitration: “Any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in St. Lucie County, Florida, or by video conference. Either party may instead bring an individual claim in small-claims court. YOU AND K-METHOD WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS OR REPRESENTATIVE ACTION. You may opt out of this arbitration agreement by emailing [legal@kmethod.com] within 30 days of first accepting these Terms, stating your name and that you opt out. If the class-action waiver is found unenforceable, this arbitration agreement does not apply to that claim.
15. Changes
We may update these Event Terms. The version in effect when you register applies to that registration, except that changes required by law or for safety apply immediately.
